PAN-Aadhaar inoperative — the cascade that costs you 20% TDS, refunds, and DTAA relief
A PAN not linked with Aadhaar has been inoperative under Sec 139AA(2) since 1 July 2023; the last free deadline was 30 June 2023. Linking now needs a ₹1,000 fee under Sec 234H. Until it's linked, TDS applies at 20% under Sec 206AA, TCS at a higher rate under Sec 206CC, and refunds are withheld.
What Sec 139AA says
Section 139AA(2) mandates every person eligible to obtain Aadhaar to intimate his Aadhaar number to the income-tax department. Non-intimation by the prescribed date results in the PAN being declared "inoperative" — and the consequences specified in CBDT Notification 30-Mar-2022 follow.
Who is exempt from PAN-Aadhaar linkage
- Non-residents (NRIs / OCIs / PIOs without Aadhaar enrollment).
- Persons aged ≥ 80 years.
- Residents of Assam, Meghalaya and J&K (per Notification SO 1252(E)).
Everyone else who held PAN as on 1-July-2017 had to link with Aadhaar. Latest fee-based linkage window opened with ₹1,000 fee under Sec 234H.
The cascading consequences of inoperative PAN

How to make PAN operative again
- Go to
www.incometax.gov.in→ Link Aadhaar (under Quick Links). - Enter PAN + Aadhaar number.
- Validate via OTP on Aadhaar-registered mobile.
- Pay ₹1,000 under Sec 234H via challan (head of payment: "Fee for delayed linking of PAN with Aadhaar").
- Confirm linkage. PAN becomes operative within 30 days (sometimes sooner).
Name mismatch — the most common stumbling block
The linkage fails if PAN data and Aadhaar data don't match in:
- Name — exact spelling, including middle name.
- Date of birth.
- Gender.
If there's a mismatch:
- Update Aadhaar at UIDAI portal (more flexible) OR
- Update PAN via Form 49A correction (more rigid; requires document proof).
Get one record to match the other and retry. Most cases are name spelling (an extra space, initials vs full middle name).
NRI / OCI special considerations
NRIs / OCIs who do NOT have Aadhaar:
- Are exempt from Sec 139AA linkage requirement.
- But the PAN status field on the IT portal sometimes erroneously shows them as "inoperative".
- To fix: update NRI status on the IT portal (Login → My Profile → Update residential status) AND on the AO records (Form for change of residential status with the AO).
NRIs receiving inoperative-PAN notifications should write to their jurisdictional AO with a copy of passport + visa + foreign tax residency certificate to seek manual reclassification.
For TDS deductors — what to do when payee's PAN is inoperative
If you discover at deduction time that your payee's PAN is inoperative:
- Deduct at the higher of: (a) twice the normal rate, OR (b) 20%, whichever is higher — per Sec 206AA.
- File Form 26Q (or applicable) with the higher rate.
- Issue Form 16A to payee for the higher rate.
- Inform payee in writing (email, SMS, even via the Form 16A note) that they should reactivate PAN to claim credit at full rate.
If you deduct at normal rate and the payee's PAN is inoperative at time of deduction, the IT department can later disallow the Sec 40(a)(ia) deduction and impose interest under Sec 201(1A) on the under-deduction.
Verification check — every quarter
For corporate TDS deductors / brokers / employers, build a quarterly automated check:
- Use the IT department's "Verify PAN" bulk API or web portal.
- Pull each payee's PAN-Aadhaar link status.
- Flag inoperative PANs in your AR / payroll system.
- Notify the payee + flag for higher TDS.
What changes once you reactivate
Post-reactivation:
- TDS revert to normal rates going forward.
- Pending refunds released within 30-60 days.
- Over-deducted TDS from the inoperative period: claim via revised TDS return by deductor + refund via ITR.
- Bank / broker / employer status flips back to "active".
- SFT / AIS updates within the next quarterly cycle.
What does NOT auto-revert: interest on delayed refund for the inoperative period — that's lost. Plan accordingly.
Common mistakes
- Assuming "I filed ITR, so PAN must be linked". Wrong. ITR filing and PAN-Aadhaar linking are independent. You can file ITR with an inoperative PAN (it gets processed slowly, refund withheld).
- Paying ₹1,000 without retrying linkage. If your name mismatch persists, payment doesn't fix it. Fix the mismatch first, then pay.
- Linking via a third-party portal. Use the official IT department portal only. Some scammy sites charge ₹500+ "convenience fee" and don't actually link.
- NRI ignoring the inoperative status. Even though NRIs are exempt, the system flag may still cascade. Proactively update residential status.
- Deductor not verifying PAN status before paying. One bulk verification per quarter takes 30 minutes; ignoring it exposes the deductor to Sec 40(a)(ia) disallowance + Sec 201 interest.
Bottom line
An inoperative PAN is not a minor inconvenience — it's a 20% TDS / 5% TCS / refund-freeze / DTAA-denial cascade. The fix is ₹1,000 + a 2-minute OTP on the IT portal. If your name doesn't match between PAN and Aadhaar, fix Aadhaar first (more flexible). For NRIs, update residential status on the IT portal AND with your AO. For TDS deductors, build a quarterly PAN-status verification into payroll / AP cycles. The cost of complacency is real money that no one will refund.
