Review your status and income together

Check residence each year before deciding which income falls within Indian tax. A foreign account or an overseas employer does not settle that question on its own.

Establish the year’s status

Review the applicable residence conditions. Returning to India does not guarantee three years of RNOR treatment.

Records to review

Travel dates, earlier residence history, citizenship, purpose of travel and relevant income records.

Trace receipt and source

For NR and RNOR, Indian receipt or deemed receipt and Indian accrual or deemed accrual remain relevant.

Records to review

Contracts, payment records and where the underlying work or income-generating activity took place.

Check the RNOR exception

Foreign accruals from an India-controlled business or an India-established profession can be included.

Form change effective 1 October 2026

CBDT Notification 121/2026 adds Schedule E to Form 141 for property payments by a resident individual or HUF to a nonresident seller, under section 393(2), table item 17 of the Income-tax Act, 2025. It also amends Form 132. The amendment starts on 1 October 2026, not its publication date of 22 September.

For Tax Year 2026-27, confirm the transaction date and buyer category before selecting a form. This procedural update does not establish a flat withholding rate or cover every kind of buyer. Earlier-year section 195 references must be read in their historical context.

NRI questions, answered

How do I know if I'm an NRI for tax purposes?

Determine residence separately for each year using section 6. Day-count tests have exceptions for qualifying visits, overseas employment and ship crew; citizenship, specified income and deemed-residence conditions also matter. The 120-day rule is not a blanket rule for everyone with income above a threshold. For Tax Year 2026-27 use section 6 of the 2025 Act; earlier years use section 6 of the 1961 Act.

What income is taxable in India for an NRI?

For a nonresident, section 5 includes income received or deemed received in India, and income accruing, arising or deemed to accrue or arise in India. Foreign salary or investments are not automatically outside Indian tax just because of their label. Establish residence, receipt and source, then assess applicable exemptions and treaty relief.

How much can I repatriate from my NRO account?

The applicable route depends on the account, source and purpose of funds, transaction date, residence, taxability and the bank’s requirements. Review these details to determine which forms and supporting records may apply. Use our repatriation tool as a starting point.

I'm selling my Indian property — what's the TDS rate?

There is no single withholding rate for every nonresident property sale. Review the transfer date, seller status, tax computation, applicable surcharge and cess, and any valid deduction certificate before payment. A resident-seller calculator does not determine this liability. For the dated Form 141 change, see the property TDS note above.

Can I claim DTAA relief?

Yes — India has DTAAs with 80+ countries. Obtain TRC from country of residence, file Form 10F online, and apply DTAA rates. For ROR with foreign income, FTC via Form 67.

What is RNOR and why does it matter?

RNOR means resident but not ordinarily resident. Eligibility is assessed each year, not granted as a fixed three-year exemption. Indian receipt and accrual rules still apply. Foreign accruals from a business controlled in India or a profession set up in India can also be included. For Tax Year 2026-27 see sections 5 and 6(13) of the 2025 Act; earlier references are sections 5 and 6(6) of the 1961 Act.
